Automated Negotiation

Automated Negotiation is ideal for monetary value claims. Its simple, easy and straight forward with no other assistance needed. The parties enter their respective offer and demand. The parties also choose a percentage range. The offer, demand and respective ranges are not communicated to the other party. The ODR INDIA algorithm computes a settlement amount between the offer range and the demand range provided the figures are within the given range. The parties are informed of the settlement. If the bids do not match, parties are allowed to try again. Any number of attempts are permitted, for a given case, within a period of 14 days. The offers and demands are not revealed to the other party, or any other person. The figures are kept confidential regardless of whether the case settles or not.


Automated Negotiation in ODRINDIA has two parts:

1. Offering Party
2. Demanding Party

Offering party is defined as the party who makes the offer or the party who is going to pay. For example, the amount of money involved in a dispute is $1000. The Offering Party is willing to offer or pay $900.

Demanding party is defined as the party who makes the demand or the party who is seeking payment. In the above example, the Demanding party is demanding or seeking payment of $1100.

When you file a case please identify yourself clearly if you are The Offering Party or the Demanding Party and then select accordingly.

Bids are defined as offer amount or demand amount.

Range % is defined as the range the parties are willing to settle at. The offer range works in an ascending manner. In the above example, if the offering party enters an offer range of 10%, it would mean that the offering party is willing to settle at any amount between the range of $900 and $990. The demand range works in a descending manner. In the above example, if the demanding party enters a demand range of 10%, it would mean that the demanding party is willing to settle at any amount between the range of $990 and $1100.

This is how it works


1. A person who wishes to settle a monetary claim clicks on “File a Case”

2. He will be presented with registration form asking him his name, address, telephone number, email and the username and password that he would like to use for this case.

3. Once he registers, he will be presented with a “First Party form”. On this form the following details need to be stated

  • 2nd Party’s email address

  • Brief account of dispute, issue or grievances. What he seeks to achieve, including any monetary value if relevant

  • Mode of Resolution – Automated Negotiation – Offering Party or Automated Negotiation Demanding Party. 1st party should identify which party he is and then select accordingly

  • Choice of Payment - 1st Party, 2nd Party or Both Parties. Please see “Fees” for further information.
  • 4. After submitting this form. The 2nd Party will receive an email informing him/her that he/she has received a request from 1st Party to resolve a dispute via ODR INDIA.

    5. The 2nd Party registers his name, address, telephone number, email and the username and password that he would like to use for this case.

    6. Once he registers, he will be presented with a “Second Party form”. This form will contain the issues stated by 1st Party. On this form the following details need to be stated by the 2nd Party:

  • Brief account of dispute, issue or grievances. What he seeks to achieve, including any monetary value if relevant

  • Whether he agrees or disagrees to use ODR INDIA’s Automated Negotiation
  • If the 2nd Party disagrees, the case is closed

    7. If the 2nd Party agrees, 1st Party is sent an email informing him/her that 2nd party has agreed and to make necessary payment before proceeding. If 2nd party payment is selected 2nd Party is sent an email to make the required payment. If both parties payment is selected then both parties are sent an email to make the required payment.

    8. Once payment is made parties are taken to the page to post their bids - amount (which may be either what they are demanding or what they are offering depending on what the parties are)

    9. For offering party, they should place their offer which is the amount they are willing to pay and should also insert an offer range. This offer range should be 5% and above but below 100%.

    10. For demanding party, they should place their demand which is the amount they are seeking and should insert a demand range. This demand range should be 1% and above but below 100%.

    11. Once the figures and ranges have been entered our system will try to match the bids based on the ODR INDIA’s system designed for this purpose.

    12. If the bids match, parties are sent an email informing them about the settlement amount.

    13. If the bids do not match, parties are sent an email stating that bids have not matched and to try again by entering another bid. When trying again another range may be entered, or another offer or demand, or both may be changed or both may be left unchanged. The choice is left to the parties. But ODR INDIA advises parties to alter bids every time so as to achieve settlement.

    Parties are allowed to try any number of times to match their bids for a period of 14 days. If within this period the bids have not been able to match, parties should file a new case after the 14day period.


    Examples of ODR INDIA Automated Negotiation

     Scenario 1  Bid by parties  %  Range
     Offering  100  10%  100-110
     Demand  80  10%  72-80

     

     

    Solution:-

    Maximum demand < Minimum offer
    = 80 < 100

    Therefore in this case - Settlement is at minimum offer which is $100

     Scenario 2  Bid by parties  %  Range
     Offering  100  10%  100-110
     Demand  150  10%  135-150


     

    Solution:-

    Maximum offer < Minimum demand
    = 110 < 150

    Therefore in this case – no settlement

     Scenario 3  Bid by parties  %  Range
     Offering  150  10%  150-165
     Demand  160  10%  144-160

     

     

    Solution:-

    The agreed range will be 150 to 160

    Therefore settlement is at mid value 150 + 160 divided by 2 which is $155

    = 150 + 160
    = 310
    = 310/2 = $155

     Scenario 4  Bid by parties  %  Range
     Offering  100  20%  100-120
     Demand  115  10%  103.5-115

     

     

    Solution:-

    The agreed range will be 103.5 to 115

    Therefore settlement is at mid value 103.5 to 115 divided by 2 which is $109.25

    = 103.5 + 115
    = 218.5
    = 218.5/2 = $109.25
